By scheduling an appointment, authorizing dental treatment, or using our patient digital platforms, you ("Patient," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our dental clinic services. These terms constitute a legally binding agreement between you and the Company.

2. Services Description

We provide professional general, cosmetic, and restorative dental services, including but not limited to comprehensive oral examinations, prophylaxis (teeth cleaning), dental x-rays, extractions, root canal therapy, implants, and periodontal treatments. All clinical procedures are performed in accordance with the standards established by the Massachusetts Board of Registration in Dentistry. We reserve the right to refuse non-emergency dental treatment if we determine that a procedure is clinically contraindicated or unsafe for the patient.

3. Treatment Plans and Estimates

All dental treatment plans and associated out-of-pocket cost estimates provided by our clinic are valid for 30 days. Initial quotes are based on preliminary clinical examinations and radiographic imaging. Final pricing may vary if underlying dental issues (such as undetected decay or bone loss) are discovered during the actual procedure. We will always seek your explicit informed consent before proceeding with any additional work that alters the original treatment plan.

4. Financial Responsibility and Insurance

Full payment for dental services, including insurance co-payments, deductibles, and non-covered procedures, is required at the time of service unless prior financial arrangements have been made. While we may assist in submitting claims to your dental insurance provider as a courtesy, you are ultimately and personally responsible for the total cost of your dental care. We accept cash, major credit cards, and approved healthcare financing (e.g., CareCredit).

5. Appointment Cancellation Policy

We reserve dedicated clinical time and specialized equipment for your dental care. We require a minimum of 48 hours' notice for the cancellation or rescheduling of any confirmed dental appointment. Failure to provide sufficient notice, or missing an appointment entirely ("no-show"), may result in a non-refundable cancellation fee billed directly to your patient account, which is not covered by dental insurance.

6. Patient Medical History Obligations

The Patient agrees to provide a completely accurate and up-to-date medical history prior to any dental treatment. This includes full disclosure of current medications, known drug allergies, cardiovascular conditions, pregnancy status, and any recent surgeries. The Company shall not be held liable for any adverse medical reactions or complications arising from the Patient's failure to disclose critical health information.

7. Clinical Outcomes and Guarantees

Dental treatments involve biological procedures performed on living tissue, and individual healing responses vary significantly. Therefore, the Company cannot guarantee specific clinical outcomes, longevity of dental restorations, or exact aesthetic results. Compliance with our prescribed post-operative care instructions and maintaining a strict regimen of oral hygiene are critical to the success of any dental procedure.

8. Intellectual Property

All digital content, website design, clinic logos, patient education materials, and written resources associated with ACK DENTAL ART INC. are the exclusive property of the Company and are protected by applicable copyright and trademark laws. You may not reproduce or distribute our educational or proprietary content without our express written permission.

9. Liability Limitation

The Company carries comprehensive medical malpractice and general liability insurance. However, for non-clinical interactions (such as website usage or administrative portal access), our liability is limited. 11. Patient Conduct

We maintain a safe, healing environment for our staff and patients. The Company reserves the right to immediately dismiss any patient from our practice who exhibits abusive, threatening, or persistently disruptive behavior toward our dental providers, hygienists, or administrative staff.

12. Dispute Resolution and Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal disputes arising from our administrative services or these terms must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state courts located in Nantucket County, Massachusetts.

13. Indemnification and Severability

You agree to fully indemnify and hold harmless ACK DENTAL ART INC., its dentists, and staff from any claims, damages, or liabilities arising from your violation of these Terms or your failure to follow prescribed post-operative clinical instructions. If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
